Scooter's Coffee® Electric Peach Sweepstakes

OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. Sponsor: Scooter’s Coffee, LLC is the sponsor (“Sponsor”) of the Scooter's Coffee Electric Peach Sweepstakes (the “Sweepstakes”).
2. Eligibility: This Sweepstakes is open only to persons who are the age of majority in their state of residence as of July 16, 2024. Notwithstanding the foregoing, any employees, independent contractors, interns, officers, directors, and agents of Sponsor or any of Sponsor’s affiliates, subsidiaries, advertising and promotion agencies, and suppliers (and any family or household members of such individuals) are not eligible to participate in this Sweepstakes. Each individual who is eligible to participate in this Sweepstakes shall be referred to in these Official Rules as a “Participant”. This Sweepstakes is subject to all applicable laws and regulations, and is void where prohibited.
3. Agreement to Rules: By entering this Sweepstakes, Participant  agrees to comply with and abide by these Official Rules and the decisions of Sponsor, and represents and warrants that Participant meets the eligibility requirements. In addition, Participant agrees to accept Sponsor's decisions as final and binding as it relates to the content of this Sweepstakes and these Official Rules. 
4. Entry Period: This Sweepstakes begins at on July 16, 2024 at 12:00AM CDT and ends on July 21, 2024 at 11:59PM CDT (the "Entry Period"). 
5. How to Enter: During the Entry Period, Participants may enter this Sweepstakes by any one or more of the methods described below, with each method selected resulting in the number of entries designated below being submitted on behalf of the Participant.
   1. Online Entries. Participant may submit one or more entries to this Sweepstakes as permitted by any one or more of the following online methods:
      1. “Like” the original Promoter Post related to this Sweepstakes on Instagram;
      2. Follow Scooter’s Coffee on Instagram; and
      3. Tag a friend on to Promotor Post related to this Sweepstakes on Instagram.
6. Prizes:  Twenty Five (25) winners of this Sweepstakes (each, a "Winner") will be randomly selected, as further described below, to each receive one prize as follows:
   1. Each winner will receive:
      1. Two (2) Electric Peach Infusion Pool Floaties; and
      2. One (1) $25 Scooter’s Coffee Gift Card or Credit on Participant’s Scooter’s Coffee mobile app;
   2. Prizes consist of only of those items specifically listed as part of each prize. No cash equivalent or other prize substitution will be permitted except at Sponsor's sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value. All prizes will be awarded and are non-transferable by any Winner. If a potential Winner is disqualified for any reason, Sponsor may award the applicable prize to an alternative Winner by random drawing from among all remaining eligible entries. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of each Winner. Acceptance of a prize constitutes permission for Sponsor to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
7. Odds of Winning: The odds of winning this Sweepstakes depends on the number of eligible entries received during the Entry Period.
8. Winner Selection and Notification: Twenty-Five (25) Winners of this Sweepstakes will be selected by a random drawing on or about July 21, 2024. The potential Winners will be notified within 10 business days of their selection by email or phone. Potential Winners may be required to sign and return a completed affidavit of eligibility and release(s) via fax or email within 48 hours of prize notification, with the original documents sent to Sponsor via regular mail within seven (7) days of the date of prize notification.  Non-compliance with these Official Rules, the inability of Sponsor to timely contact a potential Winner, a potential Winner’s failure to claim a prize within 10 business days from the time Sponsor sent the award notification, or a prize’s or prize notification’s return as undeliverable will result in such potential Winner’s disqualification and, at Sponsor’s discretion, Sponsor may award the applicable prize to a potential alternative Winner.   Receipt of each prize offered in this Sweepstakes is conditioned upon compliance with all applicable federal, state, and local laws and regulations and these Official Rules. Allow 6-8 weeks from the date declared a Winner for delivery of a prize.
9. Rights Granted by the Entrant: By entering this Contest and submitting any content (e.g., photo, video, text, etc.), Participant understands and agrees that Sponsor and anyone or entity acting on behalf of Sponsor or its affiliates or its or their respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, Participant’s entry, name, portrait, picture, voice, likeness, image, statements about this Contest and/or Scotter’s Coffee, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering this Contest, Participant represents and warrants that Participant’s entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If Participant’s entry infringes or is alleged to infringe upon the intellectual property right of another, Participant’s entry will be disqualified at the sole discretion of Sponsor. If the content of Participant’s entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, Participant shall, at Participant’s sole expense, defend or settle against such claims. Participant shall indemnify, defend, and hold harmless Sponsor and Sponsor’s affiliates from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Sponsor and Sponsor’s affiliates may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right. By entering this Contest, Participant also agrees to be interviewed and photographed by Sponsor announce on scooterscoffee.com and related websites owned and operated by Sponsor the Winner of this Contest and Participant accepts such prize, if Participant is randomly selected as full name, photo, likeness, and statements and publish a post with such items to Participant’s and that Sponsor may all social media accounts including Facebook, Instagram, Twitter, and any other social media platforms, and any other forms of media.
10. Terms and Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Contest should virus, bug, non-authorized human intervention, fraud, and that Sponsor may all social media accounts including Facebook, Instagram, Twitter, and any other social media platforms, and any other forms of media. or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of this Contest. In such cases, Sponsor may select the Finalists from eligible entries received as of the date of such action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any Participant who violates these Official Rules or tampers or attempts to tamper with the entry process, the operation of this Contest, or any website. Sponsor has the right, in its sole discretion, to maintain the integrity of this Contest and to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses or multiple entries from the same computer in excess of that allowed by the Official Rules; or the use of bots, macros, scripts, or other technical means for entering; or the submission of an entry containing any content that Sponsor, in its sole discretion, determines is profane, offensive, illegal, or otherwise not aligned with the values of Sponsor . Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of this Contest may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.
11. Limitation of Liability: By entering this Contest, Participant agrees to waive all right to, and to release and hold harmless Sponsor and its affiliates, and its and their respective advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from, any claim, liability, loss, damage and expense (including attorneys’ fees) that may arise out of or in connection with participation in this Contest or the acceptance, possession, use, or misuse of any prize or any portion thereof, whether caused by negligence or not. In no event will Sponsor and its affiliates, and its and their respective advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors, be responsible for: (i) lost, late, incomplete, or incorrect entries; (ii) a Participant's failure to receive prize notices due to the Participant's spam, junk e-mail, or other security settings or the Participant's provision of incorrect or otherwise non-functioning contact information; (iii) unauthorized human intervention in any part of this Contest; (iv) electronic or human error which may occur in the administration of this Contest or the processing of entries in this Contest; (v) technical, hardware, or software errors or malfunctions of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Contest; (vi) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vii) any typographical, technological, printing, or other error in the offer or administration of this Contest or announcement of its prizes; or (viii) lost, late, postage due, misdirected, or undeliverable mail.
12. Choice of Law and Forum: Participant agrees that all matters arising out of or relating to this Contest and these Official Rules are governed by, and construed in accordance with, the laws of the state of Nebraska, without giving effect to any of its conflict of laws principles. Participant further agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest and these Official Rules, shall be resolved individually, without resort to any form of class action, and exclusively before any applicable federal or state court located in Omaha, Douglas County, Nebraska. Further, in any such dispute, under no circumstances shall Participant be permitted to obtain awards for, and Participant hereby waives all rights to, punitive, incidental, or consequential damages, including without limitation attorney’s fees, other than actual out-of-pocket expenses (i.e., any costs associated with entering this Contest), to the extent permitted by law. Participant further waives all rights to have damages multiplied or increased.
13. Winners List: To request a copy of the Grand Prize Winners and Second Prize Winners’ list, available after August 14, 2024, please please email [email protected]. Requests must be sent within four (4) weeks of the end of the Entry Period.
14. No Sponsorship/Endorsement: This Contest is in no way sponsored, endorsed, or administered by or associated with Facebook, Twitter, Instagram, or any other social networks that are used to share this Contest, and Participant completely releases Facebook, Twitter, Instagram, and any such other social networks from any and all claims related to or arising from this Contest. Participant understands that Participant is providing Participant’s information to Sponsor of this Contest and not to Facebook, Twitter, Instagram, or any other social network.
15. Acceptance of Rules: By participating in this Contest, Participant acknowledges and agrees that Participant has affirmatively reviewed, accepted, and agreed to all of the Official Rules.
